1. Agreement to Terms

By downloading, accessing, or using the Lampkin 2028 mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and the Xavier Lampkin 2028 Presidential Campaign ("Campaign," "we," "us," or "our").

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age, you must have your parent or legal guardian's permission to use the App and agree to these Terms on your behalf.

2.2 Account Registration

To access certain features of the App, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.3 One Account Per Person

Each user may only maintain one account. Creating multiple accounts is prohibited and may result in termination of all associated accounts.

3. Description of Service

The Lampkin 2028 App is a community platform designed to:

• Facilitate discussion about political issues and the 2028 presidential campaign
• Allow supporters to engage with campaign content and each other
• Provide updates and information about Xavier Lampkin's presidential campaign
• Enable direct communication between the campaign and supporters

4. User Conduct and Content Standards

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Content:

• Post content that is defamatory, obscene, pornographic, or sexually explicit
• Post content that promotes violence, terrorism, or hatred against individuals or groups
• Post content containing racial slurs, ethnic slurs, or discriminatory language
• Post threats, harassment, or intimidation toward any person
• Post spam, unsolicited advertising, or promotional materials
• Post false or misleading information presented as fact
• Post content that infringes on intellectual property rights of others

Prohibited Behavior:

• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Attempt to gain unauthorized access to other user accounts or App systems
• Use automated scripts, bots, or other means to access the App
• Interfere with or disrupt the App's servers or networks
• Circumvent any content filtering or moderation systems
• Use the App to collect or harvest user information without consent
• Engage in any activity that violates applicable laws or regulations

4.2 Content Moderation

We employ automated content moderation systems and human review to enforce these standards. Content that violates our policies may be:

• Automatically rejected before posting
• Removed after posting
• Result in warnings to your account
• Result in temporary or permanent suspension of your account

4.3 Reporting Violations

Users may report content that violates these Terms. We will review reports and take appropriate action at our discretion. False or malicious reporting may result in action against the reporting account.

4.4 User Blocking

You may block other users to prevent them from seeing your content and vice versa. Blocking is a personal choice and does not constitute a report of violation.

5. Intellectual Property

5.1 Campaign Content

All content provided by the Campaign, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of the Xavier Lampkin 2028 Campaign or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 User-Generated Content

You retain ownership of content you post to the App. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the App and the Campaign's promotional activities.

5.3 Content Removal

You may delete your own posts at any time. Upon account deletion, we will remove your content from public view, though backup copies may be retained for legal compliance purposes.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

7. Account Suspension and Termination

7.1 Suspension by Us

We may suspend or terminate your account, at our sole discretion, for any reason, including but not limited to:

• Violation of these Terms
• Violation of Community Guidelines
• Conduct that we determine is harmful to other users, the Campaign, or third parties
• Conduct that could expose us to legal liability
• Extended periods of inactivity

7.2 Termination by You

You may delete your account at any time through the App's Settings. Account deletion will:

• Permanently remove your profile information
• Permanently remove all posts you have created
• This action cannot be undone

7.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Disclaimers

8.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

8.3 User Content

We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any user-generated content. You understand that by using the App, you may be exposed to content that might be offensive, harmful, inaccurate, or otherwise inappropriate.

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE CAMPAIGN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP, ANY CONTENT OBTAINED FROM THE APP, OR UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless the Campaign and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, including intellectual property or privacy rights, or any content you post to the App.

11. Political Disclaimer

11.1 Campaign Communications

The App is operated by the Xavier Lampkin 2028 Presidential Campaign. Content posted by the Campaign represents the views and positions of the Campaign.

11.2 User Views

User-generated content represents the views of individual users and does not necessarily reflect the views or positions of Xavier Lampkin or the Campaign.

11.3 No Government Affiliation

The App is not affiliated with any government entity. The Campaign is a private political organization.

11.4 Paid for By

Paid for by Lampkin 2028.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@xavierplatforms.com. We will try to resolve the dispute informally by contacting you via email.

12.2 Arbitration Agreement

If we cannot resolve the dispute informally, you and we agree to resolve any claims relating to these Terms or the App through final and binding arbitration, except as set forth below.

12.3 Exceptions

You may assert claims in small claims court if your claims qualify. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12.4 Class Action Waiver

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Utah.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting a notice in the App, sending an email to the address associated with your account, and updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and us regarding the App.

15.2 Severability

If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and neither party has any authority to bind the other.

17. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE APP.
