Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and XavierPlatforms ("we," "us," "our," or the "Company"), governing your access to and use of the WeGotYou mobile application ("App") and all related services, features, and content (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Eligibility

Age Requirements

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

Legal Capacity

By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms, you are not barred from using the Service under applicable law, and you will comply with these Terms and all applicable laws and regulations.

2. Account Registration

To use the Service, you must create an account using Sign in with Apple. You agree to provide accurate and complete information, keep your account information current, maintain the security of your account credentials, and accept responsibility for all activities under your account.

Each user may have only one account. Creating multiple accounts is prohibited and may result in termination of all accounts.

3. Description of Service

WeGotYou is a safety-focused messaging application that enables users to:

• Create and join private groups ("Circles") with trusted contacts
• Share messages, photos, videos, and voice messages within groups
• Share location information with group members
• Activate safety sessions ("Walking Home," "Watch Me," "Date Mode")
• Send emergency SOS alerts to group members
• Perform safety check-ins

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to scheduled maintenance, unscheduled technical issues, network problems, or other circumstances beyond our control.

4. Safety Features Disclaimer

No Guarantee of Safety

While WeGotYou is designed to help you share safety information with trusted contacts, WE DO NOT AND CANNOT GUARANTEE YOUR SAFETY. The Service does not monitor your location for safety purposes, does not dispatch emergency responders, does not verify that group members will respond to alerts, and does not confirm the reliability or accuracy of location data.

Technology Limitations

The effectiveness of safety features depends on factors beyond our control including device battery, cellular/Wi-Fi connectivity, GPS signal availability, push notification delivery, and whether group members see and respond to alerts.

5. User Conduct and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not use the Service for any illegal purpose, harass or threaten other users, introduce viruses or harmful code, or attempt to gain unauthorized access to the Service.

6. Location Services

To use location features, you must grant the App permission to access your device's location. We recommend granting "Always" permission for safety features to work properly, including background location tracking during safety sessions, arrival detection via geofencing, and location sharing in SOS emergencies.

Location information may be inaccurate, delayed, or unavailable. Accuracy depends on GPS signal availability, device hardware, environmental conditions, and network connectivity. You should not rely on location information for critical safety decisions.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT THE SAFETY FEATURES WILL FUNCTION CORRECTLY, ALERTS WILL BE DELIVERED OR RECEIVED, LOCATION INFORMATION WILL BE ACCURATE, GROUP MEMBERS WILL RESPOND TO ALERTS, OR THE SERVICE WILL PROTECT YOU FROM HARM.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR FAILURE OF SAFETY FEATURES TO FUNCTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Dispute Resolution and Arbitration

Before filing any claim, you agree to try to resolve the dispute informally by contacting us at privacy@xavierplatforms.com. We will attempt to resolve the dispute within 60 days.

IF WE CANNOT RESOLVE A DISPUTE INFORMALLY, YOU AND THE COMPANY AGREE TO RESOLVE ANY DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

10. Termination

You may terminate your account at any time by deleting your account through the App settings or contacting us at privacy@xavierplatforms.com.

We may suspend or terminate your account at any time, with or without cause, with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service immediately ceases.

BY USING WEGOTYOU, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS OF SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS, YOU UNDERSTAND THE SAFETY FEATURES HAVE SIGNIFICANT LIMITATIONS, YOU WILL NOT RELY SOLELY ON THE APP FOR PERSONAL SAFETY, YOU WILL ALWAYS CONTACT EMERGENCY SERVICES (911) IN EMERGENCIES, AND YOU ACCEPT THE RISKS ASSOCIATED WITH USING THE SERVICE.
